1. Introduction

1.1 These Driver Terms & Conditions ("Terms") govern your registration and use of the platforms, mobile apps, websites and services operated by RIDESHARE LIMITED ("Rideshare", "we", "us", "our").

1.2 Rideshare operates several branded platforms, including Football Rideshare, Mountain Rideshare, Surf Rideshare and Festival Rideshare (collectively, the "Brand Platforms").

1.3 By registering as a Driver or offering any Trip, you confirm that you accept these Terms, as well as our Passenger Terms, Privacy Policy, Cookie Policy, and any applicable Brand-specific Addendum.

1.4 If you do not agree, you must not offer Trips through the Platform.

2. Definitions

  • "Driver" – a user offering a lift using their privately owned or lawfully operated vehicle.
  • "Passenger" – a user booking a seat on a Trip.
  • "Trip" – a journey posted on the Platform.
  • "Price Contribution" – the cost-sharing amount collected from Passengers.
  • "Service Fee" – the fee retained by Rideshare.
  • "Platform" / "Services" – the websites, apps, and digital systems operated by Rideshare.
  • "User" – any registered Driver or Passenger.

3. Nature of Service & Legal Status

3.1 Rideshare acts solely as an intermediary enabling private individuals to share travel costs.

3.2 Rideshare does not:

  • provide transportation or taxi services;
  • employ or supervise Drivers;
  • own or maintain vehicles;
  • act as a carrier or operator.

3.3 Drivers and Passengers enter into a private, non-commercial agreement for each Trip.

3.4 Drivers understand that they operate independently and at their own risk.

4. Eligibility to Drive

To register as a Driver, you must:

4.1 Be at least 18 years old.

4.2 Hold a valid driving licence legally recognised in the country where you operate.

4.3 Own or be authorised to drive the vehicle used for Trips.

4.4 Ensure the vehicle is roadworthy, safe, taxed (if applicable), and compliant with local regulations.

4.5 Maintain valid motor insurance that permits carrying passengers on a cost-sharing basis.

5. Cost-Sharing Requirements

5.1 All Trips operated through the Platform must follow a cost-sharing model.

5.2 This means:

  • Price Contributions must only cover running costs such as fuel, tolls, parking, and wear & tear;
  • Drivers must not profit from Trips;
  • Trips must not resemble taxi, private hire, or professional driving services.

5.3 Rideshare may set maximum or recommended Price Contributions to ensure compliance.

5.4 Drivers must not solicit or accept payments outside the Platform.

6. Offering a Trip

6.1 Drivers may publish Trips on the Platform including route, departure time, stops, number of seats and expected Price Contribution.

6.2 Passengers may request to join; the Platform may auto-confirm or allow manual acceptance.

6.3 Drivers must honour confirmed bookings unless cancellation is necessary for safety or genuine reasons.

6.4 You are responsible for the accuracy of Trip details.

7. Payments to Drivers

7.1 Payment from Passengers is handled by Rideshare or its payment processors.

7.2 The Service Fee will be deducted before any payout to the Driver.

7.3 Payout timelines may vary by region.

7.4 Drivers are responsible for their own tax reporting obligations, including any obligation to report cost contributions if required locally.

8. Cancellations & No-Shows

8.1 Drivers must cancel Trip listings promptly if plans change.

8.2 Repeated late cancellations may result in account suspension.

8.3 If a Driver does not show up for a confirmed Trip, Rideshare may release the Passengers' card holds (so they are not charged) and withhold payout.

8.4 Passengers may cancel, and may report a Trip that did not go ahead, subject to the Cancellation & Refund Policy available in the app alongside these Terms.

9. Driver Conduct

Drivers agree to:

  • treat Passengers with respect;
  • drive safely and in compliance with traffic laws;
  • follow reasonable Passenger requests when safe;
  • refrain from illegal substances, intoxication or unsafe behaviour;
  • not carry goods or persons for hire or reward beyond the cost-sharing model;
  • not transport prohibited items.

Failure to comply may result in immediate suspension or termination.

10. Vehicle Condition & Safety

10.1 Your vehicle must be clean, roadworthy, legally registered and maintained to a safe standard.

10.2 You must comply with applicable regulations regarding seatbelts, child seats, and vehicle fitness.

10.3 Rideshare does not inspect or verify vehicles; responsibility lies entirely with the Driver.

11. Insurance Requirements & Liability

11.1 You are solely responsible for ensuring your insurance policy covers carrying passengers on a cost-sharing basis.

11.2 Rideshare does not verify or endorse any insurance coverage.

11.3 You acknowledge that you:

  • travel and carry Passengers at your own risk;
  • remain fully responsible for your vehicle, driving, and legal compliance;
  • shall indemnify Rideshare for claims arising from your breaches or negligence.

11.4 Rideshare's total liability to you is limited as described in Section 15.

12. Ratings & Reviews

12.1 Rideshare may introduce ratings and reviews allowing Passengers to rate Trips and provide feedback. This feature may not be available at all times or on all Brand Platforms.

12.2 Where ratings are available, Rideshare may monitor them and take action based on patterns of complaints or unsafe conduct.

12.3 Reviews may be moderated or removed at Rideshare's discretion.

13. Gamification & CO₂ Savings

13.1 The Platform may calculate CO₂ savings, eco-badges, or achievements based on Trip and vehicle data.

13.2 These values are estimates only for community and engagement purposes.

13.3 Participation is optional, and data is processed according to the Privacy Policy.

14. Partner Promotions & Rewards

14.1 Drivers may benefit from optional promotions with clubs, festivals, sponsors or event partners.

14.2 Participation may require limited data-sharing, disclosed in the Privacy Policy.

14.3 Promotions may be modified or discontinued at any time.

15. Rideshare's Liability

15.1 Rideshare is not liable for:

  • accidents, injuries or damage occurring during Trips;
  • the conduct of Passengers;
  • vehicle breakdowns or misrepresentation by Drivers;
  • delays, cancellations or route changes;
  • any loss arising from your breach of these Terms.

15.2 To the fullest extent permitted by law, Rideshare's aggregate liability to a Driver shall not exceed:

  • £100, or
  • the total Service Fees retained from that Driver in the preceding 12 months,

whichever is greater.

15.3 Nothing limits liability for death, personal injury caused by negligence, fraud, or where limitation is prohibited by law.

16. Termination & Suspension

16.1 Rideshare may suspend or terminate your account if you:

  • breach these Terms;
  • endanger Passengers;
  • provide false information;
  • misuse the Platform;
  • receive consistently poor ratings.

16.2 You may close your account at any time.

16.3 Provisions relating to liability, indemnity, and IP survive termination.

17. Amendments

17.1 Rideshare may amend these Terms at any time.

17.2 Changes will be published with a new "Last Updated" date.

17.3 Continued use of the Platform constitutes acceptance.

18. Governing Law & Jurisdiction

18.1 These Terms are governed by the laws of England and Wales, subject to mandatory consumer law where applicable.

18.2 Legal proceedings may be brought in the courts of England and Wales unless local law allows otherwise.

19. Dispute Resolution

19.1 Drivers should contact support first to resolve complaints.

19.2 You may use an approved ADR provider.

19.3 US-based Drivers may be directed to arbitration where lawful.
