1. Introduction

1.1 These Passenger Terms & Conditions ("Terms") govern your use of the platforms, websites, applications and related services operated by RIDESHARE LIMITED ("Rideshare", "we", "us", "our").

1.2 Rideshare operates multiple branded services, including Football Rideshare, Mountain Rideshare, Surf Rideshare, and Festival Rideshare (each a "Brand Platform").

1.3 By accessing or using the Services, you confirm that you accept these Terms, together with our Privacy Policy, Cookie Policy, Driver Terms & Conditions, and any Brand-specific Addendum.

1.4 If you do not agree to these Terms, you must not use the Services.

2. Definitions

  • "Account" – your registered user profile.
  • "Passenger" – a user booking a seat on a Trip.
  • "Driver" – a user offering a lift in a private vehicle on a cost-sharing basis.
  • "Trip" – a journey posted by a Driver.
  • "Price Contribution" – the cost-sharing amount a Passenger pays.
  • "Service Fee" – the fee retained by Rideshare for providing the Platform.
  • "Platform" / "Services" – the websites, mobile apps, and features operated by Rideshare.

3. Nature of Service (Intermediary Only)

3.1 Rideshare acts solely as an intermediary connecting private individuals for cost-sharing travel.

3.2 We do not:

  • operate as a transport provider, taxi, chauffeur or bus service;
  • employ or contract Drivers;
  • own or maintain any vehicles;
  • assume liability for Trips or user conduct.

3.3 A Trip constitutes a private arrangement between the Driver and Passenger.

3.4 We do not supervise or control Drivers, vehicle condition, or safety.

4. Eligibility & Account Requirements

4.1 You must be at least 18 years old to register.

4.2 All information provided must be accurate and kept updated.

4.3 You must not:

  • create multiple Accounts;
  • impersonate someone else;
  • share your Account with others.

4.4 We may conduct identity or verification checks where appropriate.

5. Booking a Trip

5.1 When you request a seat, the Driver may accept manually or the Platform may auto-confirm.

5.2 Once confirmed, a binding arrangement arises between you and the Driver.

5.3 You must meet the Driver at the agreed time and location.

5.4 All communication must occur through in-platform messaging tools.

6. Cost-Sharing & Payments

6.1 All Trips on the Platform operate on a cost-sharing basis, meaning:

  • Price Contributions only offset a Driver's running costs
  • Drivers must not profit from offering seats
  • The service must not resemble a taxi or commercial hire service

6.2 Payment is processed via Rideshare or its payment partners.

6.3 The Service Fee is deducted automatically.

6.4 Rideshare may set price caps or suggested contributions to ensure compliance.

6.5 You are responsible for any payment provider charges.

6.6 When your booking is confirmed, your card is authorised (a hold is placed) for the total amount; it is not charged at that point. The Price Contribution and Service Fee are captured (charged) only after the Trip has taken place. For Trips booked more than seven days in advance, the authorisation may be released and re-placed periodically until the Trip; this is the same single payment, not a repeat charge, though your bank may show the hold appearing and disappearing. What happens if a Trip does not go ahead is set out in the Cancellation & Refund Policy.

7. Cancellations & Refunds

7.1 Cancellations and refunds follow the Cancellation & Refund Policy, which is available in the app alongside these Terms and forms part of them.

7.2 Because your card is authorised but not charged until after the Trip (see clause 6.6), cancelling before the Trip releases the hold in full — you are not charged and there is no cancellation fee.

7.3 If a Driver cancels, or if a Trip does not go ahead and you report this as set out in the Cancellation & Refund Policy, the hold is released in full and you are not charged.

7.4 Rideshare may issue refunds or credits at its discretion.

7.5 Rideshare is not liable for other costs arising from delays or cancellations.

8. Passenger Conduct

You agree to:

  • behave respectfully towards Drivers and other Passengers;
  • avoid illegal substances, intoxication, or unsafe behaviour;
  • not transport prohibited items;
  • not interfere with the Driver's safe operation of the vehicle.

Failure to comply may result in suspension or termination of your Account.

9. Insurance & Travel Risk

9.1 Drivers use their own private vehicles and are responsible for ensuring their insurance covers carrying passengers on a cost-sharing basis.

9.2 Rideshare does not verify insurance policies.

9.3 You acknowledge that:

  • travelling with private individuals carries inherent risks;
  • Rideshare is not responsible for accidents, injuries, vehicle condition, breakdowns, or user behaviour.

9.4 You travel entirely at your own risk.

10. Ratings & Reviews

10.1 Rideshare may introduce ratings and reviews allowing Passengers and Drivers to rate each other after a Trip. This feature may not be available at all times or on all Brand Platforms.

10.2 Where ratings are available, Rideshare may remove or moderate them and may suspend users based on repeated poor ratings or misconduct.

11. Gamification & CO₂ Savings Features

11.1 The Platform may display estimated CO₂ savings, eco-scores, achievements, or badges.

11.2 All sustainability metrics are estimates only and may not reflect scientific accuracy.

11.3 Data related to these features is processed according to the Privacy Policy.

12. Partner Promotions & Rewards

12.1 Rideshare may offer optional partner promotions (e.g., stadium, festival, or outdoor-brand benefits).

12.2 Participation is voluntary and may involve limited data-sharing with partners.

12.3 Rideshare may update or withdraw such promotions at any time.

13. Data Protection & Privacy

13.1 Your personal data is processed in accordance with our Global Privacy Policy.

13.2 By using the Platform, you consent to the processing of location, trip and usage data for matching, safety, analytics, and fraud prevention.

14. Intellectual Property

14.1 All logos, brand assets, code, design systems and materials belong to RIDESHARE LIMITED.

14.2 User-generated content (reviews, trip information) is licensed to Rideshare for platform operation.

15. Amendments

15.1 Rideshare may amend these Terms at any time.

15.2 Updated versions will feature a new "Last Updated" date.

15.3 Continued use of the Platform constitutes acceptance.

16. Termination

16.1 Rideshare may suspend or terminate your Account for:

  • breach of these Terms;
  • unsafe behaviour;
  • fraudulent activity;
  • misuse of the Platform.

16.2 You may close your Account at any time.

16.3 Clauses relating to liability, IP, and governing law survive termination.

17. Governing Law & Jurisdiction

17.1 These Terms are governed by the laws of England and Wales, subject to applicable consumer laws in your country.

17.2 Legal proceedings may be brought in the courts of England and Wales, unless mandatory local law permits otherwise.

18. Dispute Resolution

18.1 Please contact support first to resolve complaints.

18.2 You may use an approved alternative dispute resolution (ADR) body.

18.3 US users may be subject to arbitration where permitted by law.
